What is the Canadian South 70 Hour 7 Day Cycle 1 Rule?

The Canadian South 70 Hour 7 Day Cycle 1 rule applies to all commercial vehicles operating under the Canadian Commercial Vehicle Drivers Hours of Service Regulation SOR/2005-313 under which on-duty time is accumulated over a period of 7 days except;

 

  • 2 or 3 axle commercial vehicles transporting or returning from transporting primary products of a farm, sea or lake, if the driver is the producer of the products or is transporting products used in its principal operations,

  • emergency vehicles,

  • commercial vehicles driven for personal use if the vehicle is unloaded, trailer unhitched, the distance traveled does not exceed 75 km, the driver is not subject to out of service declarations, and the odometer reading has been recorded before and after the personal use.

The Canadian South 70 Hour 7 Day Cycle 1 rules are:

​

  • A driver operating within the Canadian South 70 Hour 7 Day Cycle 1 rule cannot work more than 70 hours in a 7 day work week.

  • A driver operating within the Canadian South 70 Hour 7 Day Cycle 1 rule cannot work no more than 14 hours in a 24 hour day.

  • A driver operating within the Canadian South 70 Hour 7 Day Cycle 1 rule cannot drive more than 13 hours in a 24 hour period.

  • A driver operating within the Canadian South 70 Hour 7 Day Cycle 1 rule must take a daily mandatory 10 hour break prior to the completion of a 24 hour day  which must be comprised of at least 8  continuous hours either in the sleeper berth or away from the truck. The additional 2 hours can be used for meals or rest breaks while not driving at the driver's discretion as long as it does not form part of the 8 consecutive hours off duty requirement.

  • A driver operating within the Canadian South 70 Hour 7 Day Cycle 1 rule cannot restart the work week until after having completed 36 continuous hours of rest.
